Since December 2007, Quebec has given municipalities new powers with respect to wastewater disposal systems for isolated dwellings :
Any municipality can, at the fee of the owner of the property, install or maintain any wastewater disposal systems for isolated dwellings, as described in the regulation R.R.Q., 1981, chapter Q-2, r.8, or make it be in conformity with the regulation. The municipality can also proceed with the emptying of the septic tanks of any other property.
The municipality of Ste-Marguerite-du-lac-Masson has received a legal advice to guide them in the application of this new legislation. This legal advice is available, in french, at the end of this post.
In summary, the legal advice includes:
- The scope of the new legislation;
- Suggestions how to apply it, taking into comsideration different scenarios where a citizen would want to dispute the legislation;
- The confirmation that it is the municipality’s responsabilities and requirement to insure the application of law Q-2, r.8;
- The confirmation that municipalities can use their taxation privileges to automatically include the expenses incurred by the municipality on the property tax bill for owners found guilty.
